WARRANTY TERMS & CONDITIONS
Effective Date: 18 August 2026
Deltarette Engineering (Pty) Ltd (“Deltarette”) warrants that goods supplied and, where applicable, services performed by Deltarette will be free from defects in material and workmanship, subject to the terms and conditions set out below.
This warranty is provided in addition to, and does not limit, exclude or replace, any rights that a customer may have under the Consumer Protection Act 68 of 2008 (“CPA”) or any other applicable law.
1. Warranty Periods
1.1 New Products, Equipment and Components
Unless otherwise agreed in writing, Deltarette provides an express warranty of six (6) months from the date of delivery, commissioning or completion of the relevant work, whichever is applicable.
The six-month warranty covers defects attributable to faulty materials, workmanship or manufacturing, subject to the exclusions contained in these Terms & Conditions.
1.2 Repaired, Reconditioned, Refurbished or Previously Used Equipment
Unless otherwise agreed in writing, Deltarette provides an express warranty of three (3) months on repaired, reconditioned, refurbished or previously used equipment, components and workmanship.
Where a specific quotation, purchase order, contract or written warranty provides a different warranty period, that written agreement will apply.
2. What the Warranty Covers
Subject to these Terms & Conditions, Deltarette will, at its reasonable discretion and subject to applicable law:
- inspect the equipment, component or product;
- repair or rectify a confirmed manufacturing or workmanship defect;
- replace a defective component where reasonably necessary; or
- provide such other remedy as may be required by applicable law.
The warranty applies only to defects that are reasonably attributable to Deltarette's materials, workmanship, manufacture, repair or refurbishment.
3. Warranty Claim Procedure
The customer must notify Deltarette of a suspected defect as soon as reasonably practicable after discovering it.
A warranty claim should include:
- customer name and contact details;
- invoice, quotation or job number;
- description of the defect or failure;
- date on which the defect was discovered;
- photographs or other supporting information where reasonably available; and
- details of the operating conditions and use of the equipment.
Deltarette may require the product, component or equipment to be made available for inspection before determining whether the failure is covered by this warranty.
No warranty claim will be accepted as confirmed until Deltarette has had a reasonable opportunity to inspect and assess the alleged defect.
4. Warranty Exclusions
The warranty does not cover failure, damage or deterioration caused by:
- normal wear and tear;
- misuse, abuse or negligence;
- incorrect operation or use outside the intended application;
- overloading or operation outside the specified design capacity;
- incorrect installation, assembly or commissioning where installation was not performed by Deltarette;
- inadequate maintenance or failure to follow operating or maintenance instructions;
- unauthorised alterations, modifications or repairs;
- use of non-approved replacement parts where such use contributes to the failure;
- accidental damage;
- corrosion, contamination or environmental conditions outside the equipment's specified operating conditions;
- electrical supply irregularities, power surges or external electrical faults;
- damage caused by fire, flood, lightning, vandalism, acts of nature or other events outside Deltarette's reasonable control;
- defects or damage resulting from incorrect storage, transportation or handling after delivery where such matters were not under Deltarette's control;
- any condition specifically identified and accepted by the customer at the time of sale;
Normal consumable items and components subject to ordinary operational wear are excluded unless the failure is directly attributable to a defect in material or workmanship.
5. Repairs and Replacement Parts
Where Deltarette repairs or replaces a defective component under this warranty, the replacement or repaired component will be warranted for the balance of the applicable original warranty period, unless otherwise agreed in writing or a longer period is required by applicable law.
Nothing in this clause limits any statutory rights that may apply to repaired goods.
6. Third-Party Components
Where equipment supplied by Deltarette incorporates components manufactured by third parties, Deltarette may utilise the applicable manufacturer's warranty where appropriate.
This does not exclude or limit any rights or remedies available to the customer against Deltarette under applicable South African law.
7. Labour, Transport and Site Attendance
Where a defect is confirmed as being covered by Deltarette's warranty, Deltarette will determine the reasonable method of remedy.
Where appropriate, warranty-related labour may be performed at Deltarette's premises or at the customer's premises.
Unless otherwise agreed in writing, additional costs arising from travel, transport, lifting equipment, access requirements, dismantling, reinstallation or site conditions may be charged where the issue is found not to be a warranty defect or where such costs fall outside the scope of the original supply or service agreement.
Nothing in this clause limits any cost or remedy that the customer is entitled to under applicable law.
8. Customer Responsibilities
The customer is responsible for:
- operating equipment in accordance with supplied instructions;
- carrying out recommended maintenance;
- using the equipment within its specified operating parameters;
- maintaining suitable operating and environmental conditions;
- promptly reporting suspected defects; and
- taking reasonable steps to prevent further damage after a defect becomes apparent.
Failure to take reasonable steps to prevent further damage may affect the warranty claim to the extent permitted by law.
9. Inspection and Determination
Deltarette reserves the right to inspect and test any product, equipment or component before determining whether a warranty claim is valid.
If inspection establishes that the failure is not covered by the warranty, Deltarette may provide the customer with a quotation for the required repair or replacement.
No chargeable repair work will be undertaken without the customer's approval, except where otherwise agreed in writing.
10. Limitation of Warranty
This warranty applies only to defects covered by the warranty terms stated above.
Nothing in these Terms & Conditions is intended to exclude, restrict or waive any right, warranty, guarantee, remedy or obligation that cannot lawfully be excluded or limited under the Consumer Protection Act or other applicable South African legislation.
Where a statutory right provides a customer with a remedy greater than the express warranty provided by Deltarette, the statutory right will prevail.
11. Commercial and Business-to-Business Transactions
For commercial, industrial and business-to-business transactions, the warranty applicable to the particular supply, project or service may be specified in the quotation, purchase order, contract or other written agreement.
Where no specific warranty is stated in writing, the standard Deltarette warranty periods of:
- 6 months for new goods/equipment/components; and
- 3 months for repaired, reconditioned, refurbished or previously used goods/equipment/components
will apply, subject always to applicable law.
12. No Unauthorised Representations
No employee, agent or representative of Deltarette is authorised to extend, alter or vary these warranty terms unless such variation is confirmed by Deltarette in writing.
13. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Nothing in these Terms & Conditions prevents a customer from exercising any right available to it under applicable legislation.
